Update: Amelia Nicol beats charges

From Denver Anarchist Black Cross:

DA admits fear of losing at trial

It’s been a long 5 months for Amelia Nicol, a 21 year old woman from Colorado who became infamous across the region after gracing the front pages of news websites and blogs. Amelia was accused of throwing a molotov cocktail at local police (some media sites even claimed it was a pipe bomb) during the aftermath of a demonstration against Denver police on May 6th. Amelia was arrested and charged with 2 counts of attempted murder of a law enforcement officer in the first degree, one count of use of explosives, one count of possession of explosives, one count of second-degree arson, one count of criminal mischief, one count of inciting a riot, two counts of attemped third-degree assault, and one count of resisting arrest.

These seven felony and three misdemeanor charges threatened to send Amelia to prison for over 100 years. A woman who turned 21 inside a jail cell over Memorial Day Weekend faced the rest of her life in prison.

US District Judge Kane Scolds and Threatens Denver with Sanctions

The Civil Rights law firm, Killmer, Lane , & Newman has a federal lawsuit pending against the City and County of Denver after Officer Shawn Miller brutalized a Colorado citizen Jason Graber.  The case is in litigation and the City and County of Denver has failed to provide the appropriate discovery to the plaintiff.  In July, Judge Kane ordered Denver to stop the bullshit , yet it appears they have not listened.

According to the Denver Post,  Judge Kane ruled that the city and its attorneys “have chosen to invest their time and effort in meritless attempts to obstruct the discovery process. I will not tolerate persistent evasions of discovery obligations in this case.  Judge Kane then scolded Denver and warned them that if they fail to provide the proper discovery they will be sanctioned with a daily fine of 5k until they have complied with the order.  The deadline is October 6, 2011.  According to attorney Qusair Mohamedbhai, “Judge Kane’s order is based on well established law and will bring justice to the many individuals that have been brutalized by the Denver police department.”  We wonder what the city is hiding, can it be worse then what we already know?

Despicable: Devin Sparks and Randy Murr Reinstated

Officers Devin Sparks and Randy Murr have been reinstated with back pay following an announcement by the newest Manager of  Safety Ashley Kilroy.  Kilroy is not providing reasoning for the reinstatement.   Officers Murr and Sparks were fired in March of this year following the public outcry of the vicious beating of Michael DeHerrera.  9news quotes DeHerrera’s response by saying, “”I’m shocked, appalled, disappointed. We can’t believe it. There are knots in our stomachs. I guess we had it wrong. Denver police can do whatever they want to whomever they want and get away with it.”  It is high time the public as a whole realizes that the DPD operates with impunity and has a free reign to brutalize our community.
